Licensing of Selected Occupations
Important Update on the review and licensing requirements
Licensing for five occupations has been removed following the commencement of the Occupational Licensing Legislation Amendment (Regulatory Reform) Act 2009.
Licences under the Home Building Act 1989 in the occupational categories of flooring, mechanical services, building consultant, and kit home supplier were abolished on 16 September 2009. Affected tradespeople will be contacted by the Office of Fair Trading shortly.
Licensing requirements for optical dispensers will cease on 1 July 2010. Optical dispensers should note that the NSW Unregistered Health Practitioners Code of Conduct will be amended to provide that only persons with a qualification in optical dispensing at least equivalent to a Certificate IV may sell or dispense contact lenses.
Motor Vehicle Repairers who fit vehicle accessories that do not affect the performance, safety or security of a vehicle should contact the Office of Fair Trading for information on proposed clarifications to activities that require a licence.
Licensing for entertainment industry agents/managers and venue consultants will be removed following a broader review of the Entertainment Industry Act 1989.
The purpose of this targeted review was to assess the ongoing need for licensing eleven occupations in NSW. An issues paper was released in October 2008 and the Better Regulation Office completed its final report in April 2009.
The Government announced its response to the review and agreed to remove seven licences and retain licensing for four occupations.
It was agreed that licensing be immediately removed for the occupations of:
- floor finisher and coverer
- kit home supplier
- lift mechanic
- optical dispenser
- property inspector (pre-purchase)
Licensing for those five occupations was removed through the Occupational Licensing Legislation Amendment (Regulatory Reform) Act 2009.
Licensing for entertainment industry agents/managers and venue consultants will be removed following a broader review of the Entertainment Industry Act 1989 and reforms to ensure that adequate protections are in place for performers.
Licensing is being retained for the occupations of:
- motor vehicle repairer
- strata manager
- structural landscaper
- wool, hide and skin dealer
The review received Eighty-nine submissions.
