Guide to Better Regulation

The Guide to Better Regulation sets out the NSW Government’s better regulation requirements and provides guidance on how to comply with the requirements.

Section 1 provides an outline of the seven better regulation principles.

Section 2 explains how to apply the better regulation principles and contains guidance on when a Better Regulation Statement is needed as well as steps to follow when preparing a Better Regulation Statement.

Section 3 is a consultation policy for regulatory reform, which offers guidance on how to conduct effective consultation to ensure regulatory development is informed by the knowledge and experience of stakeholders.

Appendix A describes types of market failure. Appendix B provides details on non-regulatory and regulatory approaches, together with case studies. Appendix C provides information on assessing the costs and benefits of different options. Appendix D contains a Ready Reckoner to assist agencies to apply the principles during regulatory development.

The Better Regulation Office has developed other guidance tools to assist agencies to meet the better regulation requirements.

The Guide will be reviewed after 12 months of operation.
